Definitions

These general terms and conditions contain the following:

  • The organization “We-at-Sea”, to whom, the participant has agreed to take part in the activity;

  • Activity: the activity to be organized by the organization;

  • Participant: the natural person with whom the organization has entered into an agreement to participate in the activity;

  • Participating Company: a company or institution to whom, "We-at-Sea" has agreed to arrange the Activity

Applicability

  • These general terms and conditions apply to any agreement that the organization "We-at-Sea" has concluded with a participant;

  • Participant declares to be familiar with and submits to the general terms and conditions.

Portrait rights

  • Participant agrees to the possible use of his / her image in print, photo, film, video, TV, internet and the like for promotional or publicity purposes of The Organization without claiming compensation. If you object to this, you can send an email to info@we-at-sea.be

Liability

  • The participant must ensure in advance, whether or not by consulting a doctor, that his health permits the foreseen effort;

  • Participation is at your own risk. The organization is not liable for any damage, loss and / or theft, by whatever name, that the participant may suffer as a result of the participation, unless this damage is the direct result of intent or gross negligence attributable to the organization. This exclusion of liability also applies to serious types of damage, such as all possible types of damage as a result of injury or death;

  • If, despite the above provisions, liability is nevertheless accepted by the organization, this is only for the damage suffered by the participant, if and insofar as this liability is covered by the insurance taken out by the organization and up to the amount of the insurance made by this insurance. payment. If the damage is not covered by the aforementioned insurance, or if the insurer does not pay out, the liability of the organization is limited to a maximum of 100% of the registration fee.

  • The participant indemnifies the organization against damage that third parties may suffer as a result of an act or omission attributable to the participant with regard to the activity. The participant must be adequately insured against the risk of liability for such damage;

  • Sponsors of the activity and the municipality (s) in which the activity takes place are, on the same basis as the organizer, excluded from liability;

  • After the activity, if applicable, parents / guardians are responsible for the timely collection of the participant (s) at the activity location.

Participation

  • Participation in the activity is done by the participant personally. It is therefore not allowed to let someone else take part in the activity instead of the participant;

  • The participant is not permitted to transfer his rights under the agreement to a third party without prior written approval from the organization;

  • If the participant is unable to participate in the activity, the registration fee paid will not be refunded.

Cancellation

  • If the activity has to be canceled or changed due to force majeure, registration fees will be refunded up to a maximum of 80%.

  • The organization offers the possibility to reschedule a canceled activity due to force majeure once, without additional costs for the participant

Registration procedure

  • Registration in advance is possible via the website of the organization. Participant must (if applicable) pay via the payment method (s) offered on the website when registering;

  • The organization declines any responsibility in the event of illness or accidents occurring to the participant;

  • Participant must fill in his personal details completely when registering. In the event of calamities, the organization can act as optimally as possible;

  • A registration is only final if the participant has received a confirmation of receipt and can submit this - if requested -;

  • In all cases not provided for in these general terms and conditions, the organization decides;

  • If the participant is a minor, the organization assumes that the parent / guardian of the participants agrees with registration for the activity;

  • If the situation arises that the parent / guardian of the minor participant is not able to agree to participate in the activity, the organization will recover any adverse consequences for participation by a minor participant from the parent / guardian of the minor participant.

  • For complaints, we refer you to the complaints regulations of the organization. The Complaints Regulations can be requested via info@we-at-sea.be
